Yamnenko T. Financial law: branch of law, academic discipline and science.

TIn the thesis the peculiarities of financial law as of a branch of law and an academic discipline are explored. The distinctive feature of this research is integrity of elaboration of issues of the subject and method of financial-and-legal regulation. Especially ponderable is the clause that the division of financial law into general and special parts is peculiar to financial law not as a branch but as an academic discipline. Resting upon theoretical provisions the author asserts that financial-and-legal norms form financial law as a branch not immediately but through financial-and-legal institutions. Main function of each financial-and-legal institution lies in ensuring integral, relatively completed regulation within the framework of a kind, or the whole kind of financial relations. The essence and legal nature of financial law as a branch of legislation have been analyzed, its structure and co-relation of systems of financial law and financial legislation; practical recommendations have been substantiated as to improvement of system of the branch of financial law and financial legislation; theoretical grounds of the science of financial law have been considered in detail, which, foremost, is determined by the financial law of Ukraine as a branch of law and reflects the mechanism of its development.
