Essay

The dissertation is devoted to the investigation of theoretical and practical issues of the state and arbitrary control over the utilization and protection of land in Ukraine. The author has revealed legal nature of the state and arbitrary control over the utilization and protection of land, principle factors of implementing control during a transition of Ukraine to the market economy, and legal regulation of activities of government officials in fulfilling control measures over the utilization and protection of land. Forms and methods of activities of government officials who are empowered to impose administrative penalty for violation of the Land Legislature have been highlighted in the dissertation. There have been also analyzed kinds of infringements of the Land Legislature and reasons for imposing sanctions on transgressors of the Land Legislature. Much attention has been paid to the legal regulation of activities in fulfilling control measures while investigating the state power system in the area of providing control over the utilization and protection of land. Authorities of a special representative body of power in providing control over the utilization and protection of land have been significantly expanded after the adoption of the Law of Ukraine “About the state control of the utilization and protection of land” and establishment of the State Land Inspection within the State Land Committee of Ukraine. In addition, to the opinion of the dissertation’s author, control authorities on the land utilization and protection provided by the executive officials in the area of land relations and environmental protection have not been sufficiently distinguished.
