The dissertation for the degree of the Candidate of Science in Law by speciality 12.00.01 — theory and history of the state and law; history of the law and political sciences. — National University of Internal Affairs MIA of Ukraine, Kharkiv, 2004. Dissertation contains general theoretic research on legal status peculiarities of the victims of justice and power abuse. From the analysis of the proper legislation of state and scientific elaboration of the problem of responsibility of the state for a person for the illegality acts of officials in jurisprudence of our country at the end of the XIXth — 80s of the XXth century the author passes to the research of legal status nature of a person (element structure, types of legal status, legal guarantees of rights and legal interests of a person defence), forms of justice and power abuse, specifics of legal status of the victims of justice and power abuse. The characteristic features of structure of this legal status of a person are defined, system of the victims rights and state duties in breach of these rights renewal, such definitions as “victim of justice “, “victim of power abuse”, “legal status of the victims of justice and power abuse” are given. Questions about the types of legal status of the victims of justice and power abuse are analysed. Question about the features of legal relations between the state and the victims of justice and power abuse is explored. Question about the features of legal rehabilitative relations is considered; the term “rehabilitation” is exposed.
