Shchavinsky V. Criminal responsibility for illegal issuance of non-state securities

The thesis analyses corpora delicti envisaged by Article No. 223 of the Criminal Code of Ukraine, their internal and external features. The relevance of criminal prevention of illegal issuance of non-state securities has been studied. The legal terms used in the name and disposition of Article No 223 of the Criminal Code of Ukraine have been analyzed, special attention has been paid to shortcomings in their definition and the ways of correcting them. There has been researched the problem of differentiation of illegal issuance of non-state securities from other types of the crime and law infringements. The proposal has been brought forward to improve Articles No. 223 and No. 234 of the Criminal Code of Ukraine, civil and commercial legislation that regulate the procedure of securities issuance. In order to prevent the illegal issuance of non-state securities and make their issuance unprofitable, a proposal has been made to include not only the direct losses, but also the lost profit in the definition oflosses suffered from the crime by investors.
