Tsesarskyy F. Protective function of trade unions, forms of its realization.

The thesis is dedicated to complex research of protective function of trade unions and forms of its realization in circumstances of market economy. For the first time in the science of Labour Law forms of realization of protective function of trade unions are analyzed. Stages of development of legislation on trade unions conditioned by changes of socially economical and political conditions in society are shown. Law description of these stages is determined. Recommendation concerning forms of interaction between employers and trade unions in conditions of their pluralism. For the first time general features are determined and distinctions between trade unions and other representative bodies are found, advantage of trade unions during protection of labour rights is proved. Connection between quantity of members of trade unions, which are united by the trade union, and amount of authorities of representation of their interests is found out. Improvement of legislation in force, which regulates forms of fulfillment of protective function by trade unions, is proposed.
