Gonchar T. The Juvenile as a Subject of Responsibility under Criminal law of Ukraine

On the basis of current Criminal Law, Law of Criminal Procedure, Criminal-Executive Law of Ukraine, foreign criminal legislation and international legal regulations there have been done a complex research of the juvenile as a special subject of criminal responsibility. The following issues are under analysis: definition and types of the subject of a crime; legal nature of sanity and of diminished sanity; significance of completing the age of criminal responsibility and ability to realize the real nature and social danger of the committed act (action or omission) and to manage them in order to recognize a juvenile as a subject of criminal responsibility; certain problems of sanity of juveniles the chronological age of which does not coincide with the psychological one; peculiarities of juvenile criminal responsibility and punishment that are determined by age psycho-psychological and other peculiarities. According to the results of the research new theoretical concepts have been formulated, substance ofcertain terms have been defined more precisely, that are important for science, for practice and for improvement of legislation of Ukraine.
