Yasinska L. Formation and Development of the Institution of the Notariate in Ukraine /historico legal aspect.

For the first time on the level of monographical research the problem of the development of the institution of the notariate in Ukraine during X-XX centuries has been analyzed. In the thesis the preconditions, circumstances, historical forms as well as the regularities of the development of the system of the notariate in Europe, in general and in Ukraine, in particular, are the subjects of the investigation. It was concluded that the notary activity on the territory of Ukraine in the pre-Soviet period was developing in the context of West European traditions. Those positive tendencies were stopped in the Soviet Ukraine where the office was transformed into a bureaucratical body of the legislative power. The place and role of the institution of the notariate within the law system of modern Ukraine has been researched too, as well as suggestions on its improvement has been formulated.
