Nishchimna S. Legal control of the state crediting in Ukraine.

There is the stated conception of the financial-legal relations concerning the state crediting as the relations, which arise between the state, as the creditor, and the individual and legal entities, as the borrowers in the thesis. These relations are characterised by the inequality of the sides, by the factor of "power-subdual" and by the one-sided establishment of the principles of crediting from the direction of the state. The thesis proves the appearance of the new institute of finance law - state crediting in Ukraine, which can not be identified with the institute of state credit, because the creditors and the borrowers exchange their places in such relations, this fact causes the appearance of a new sort of financial legal relations. Before this the state crediting had been carried out by means of the banks, this fact made them the subject of study of the bank law. It is proved in this work, that the relations as for the state crediting are the subject of study of the finance law, because the author considers them to be the part of the budget law. The features of the financial legal relations in the field of the state crediting are studied in this work, the practice of the state crediting legal control of the separate directions of the state priority development is explored: house-building, individual house-building in the country-side, getting of higher education, crediting of the rural economies; existing legislation is analysed, the suggestions as for its' improvement are developed.
