Essay

The thesis deals with the problems of criminal responsibility for impingement on radiation safety. Application of a package of scientific methods dependent upon the object (socially dangerous acts with respect to radioactive materials as a type of crimes against public security) and the subject of investigation (effective criminal legislation on responsibility for the crimes against radiation safety, and the practice of its application, as well as the system of scientific views and developments) allowed obtaining of a number of new scientific statements. The thesis contains analysis of historical genesis of regulations of the Ukrainian legislation governing secure handling/treatment of radioactive materials; it elucidates the influence of the international conventions and other international statutory acts on its occurrence and development in the present period. For the first time, the substance of safety measures to be taken at handling of radioactive materials has been defined as a complex of sanitary, research and development, engineering, organizational and legal arrangements and means aimed at protection of individuals, material objects and environment against radiation. The analysis carried inferences being of both theoretical and practical significance, in particular, there have been formulated author's proposals as for revision of wording of the regulations on responsibility for the crimes against radiation safety.
