The dissertation has been aimed at the elaborating of the new trends in the methodology of criminal procedural lawmaking, in the philosophically legal and conceptually methodological apparatus in the modern philosophy of law. The aim of this researching is the definition of legal humanism as the factor of reforming Ukrainian criminal and procedural law. It is proved that the decision of these problems can be effective only at the complex approach to them. Legal humanism is a key principle of law. The author analyses the links between legal and humanistic bases in criminal procedure. Practical recommendations to the appliance of the modern ideas of European humanism during the improvement of criminal procedural law in Ukraine are worked ant. Such approach has the important practical value; it can assist both to theoretical maintenance and practical saturation by the humanistic essence of positions of the criminal-procedural legislation and activity of bodies of investigation, pre–trial investigation, Office of Public Prosecutor and court.
