Zadyraka N. Theoretical and Legal questions of Law-making

The object of the dissertation research is theoretical and practical aspects of law-making process. The author analyzes ways of parliaments’ establishment, organization of its structures, describes problems of legal bases of law-making process, classifies principals and ways of law creation and proves the necessity to divide administrative and peoples’ representation, and proved impossibility of law adoption without its approval in all phases of law-making process. The main goal of this process is selection of effective ways for legal regulation of social relations by the rule of law; author proposes to create the Draft Law “On consummation provisions of referendum” and to fix sanctions for misconduct of peoples’ deputies duties. Special attention is paid to the current situation in the field on legal norms’ creation on the example of bicameral parliament (Russia, Poland) and unicameral one (Ukrainian). Dissertation contains conceptual and justified proposals and conclusions on the examined matters.
