The study is a complex exploration of criminal-legal problems of sanity and insanity. Views on the notion of sanity and insanity elaborated in the theory of criminal law, the essence of the institution of sanity as a legal cate-gory are subject to analysis. The author's definitions of sanity and insanity are offered. In the paper the genesis of the institutions of sanity and insanity in criminal law of our country is explored.
