Pidgorodinskiy V. Responsibility for Traffic in Human Beings under the Criminal Legislation of Ukraine

The Thesis are devoted to the research of the traffic in human beings as well as to determination of this crime in legislation of certain states. Considerable attention is dedicated to the analysis of this phenomenon counteraction at international level. The object and the subject of this crime have been determined by the author of this Paper as well as agravative circumstances of this crime have been studied and subjective side and the subject of the crime, stipulated by Article 149 of CC of Ukraine have been investigated. Besides that delimitation of the components of this crime from adjacent crimes together with comparative analysis of criminal legislations and forseen by law responsibility for persons traffic in different countries have been performed as well. The main and direct object of this crime are social relations, connected with freedom, honesty and dignity of a person. The Competitor draws a conclusion that an objective side should include only such an action as perpetration of illegal agreements in the form of transfer and seizure of a person. A subjective side, i.e. mental element of this crime should not include an ofligatory aim of this crime. The Author has developed recommendations for the improvement of the norm concerning the responsibility for human beings traffic.
