Essay

Further definition development of the labour collective concept is given. It is suggested to divide the labour collective concept in the wide and narrow senses. There were formulated conceptual approaches to the definition of legal personality of labour collectives, its legal status and also determined the moment of accrual of labour collectives' legal capacity, active capacity and delictual responsibility. Conclusion that the realization of labour collectives' powers cannot be executed only by forms of democracy - joint institutions of public self-government (general gatherings) is grounded. Also it is necessary to set the bodies of representative democracy as conferences, boards, commissions etc. Special attention is devoted to labour collective's participation in the collective agreement process. There were described labour collective's powers regarding labour dispute solution (individual and collective).
