Svystulenko M. Extradition in the Legal System of Ukraine: General Criminal Law Aspects.

The thesis is devoted to defining and systematic study of criminal law aspects of the extradition as a complex institute in the legal system of Ukraine. The formation of a concept and structure of the mechanism of the legal regulation of extradition, the analysis of the character of its elements' interaction provided the basis for the definition of characteristic feature of its system, namely, that the functioning of the legal regulation of the extradition mechanism is determined by the violation of a criminal law provision of a certain state. It is substantiated that the obligation of a certain state as a subject of relations protected by criminal law determines the law of the state to be the subject of legal relations of the extradition. Distinctive features of the functioning of the mechanism of the legal regulation of extradition of the present-day in Ukraine are set forth. Some suggestions resulting from the research as to the improvement of the criminal law regulation of extradition in Ukraine are provided.
