Yevgraphova L. Formation of the system of national legislation (some of the issues of the theory and practice of law).

The thesis is devoted to the research of the issues of theory and practice of the formation of the system of national legislation. The author has formulated a new notion "national legislation" from the point of view of libertary and legislatory understanding of law and made a conclusion concerning the legislation as the form (but not as a source) of law. The source of legislation is law, and the source of law is the people. The author has suggested to regulate a law making process, the order of all other work the Parliament by a law making Code. The author has determined the grounds of the formation of the system of legislation, for the first time, the author has given a scientific classification. The conclusions, concerning the determination of the system of law by a doctrinal; all branches of the system of legislation are equal and reflect a definite system of the norms of law. The author has formulated the conclusions and proposals concerning the necessity of conducting of the total systematizationand codification of the legislation in Ukraine, especially in economic and social blocks, and the development of the collection of law of Ukraine.
