Grek B. Criminal responsibility for fictitious bankruptcy and conditioning to bankruptcy.

Dissertation is dedicated to juridical analysis of facts of crimes fictitious bankruptcy and conditioning to bankruptcy, indicating trends of legal security of combating fictitious bankruptcy and conditioning to bankruptcy. In the work the condition of scientific elaboration of criminal responsibility for fictitious bankruptcy and conditioning to bankruptcy problems have being analysed; the comparative analysis of institution of bankruptcy in some countries of the world and national institution of bankruptcy is given; the divergences between the notions "bankruptcy", "financial inability" and "insolvency" have being substantiated; the reasons of market participants bankruptcy have being systematized; the condition and the essence of institution of bankruptcy in Ukraine have being indicated; the role of the state in preventing bankruptcy has being depicted. The juridical analysis of crimes, specified in the articles 218, 219 of Criminal Code of Ukraine has being worked out; the problems which face the law-enforcement officers during the application of the articles 218, 219 of Criminal Code of Ukraine have being indicated; scientifically substantiated propositions on development of the articles 218, 219 of Criminal Code of Ukraine and recommendations concerning criminal forms of bankruptcy in Ukraine combating have being substantiated.
