The thesis is concerned with the problem of circumstances existing in criminal legislation which make impossible, unreasonable or non-effective implementation of certain types of punishment for certain category of persons for social, legal or other reasons. The undertaken survey confirms the shortcomings in construction and practical realization of acting criminal norms of law as to the circumstances mentioned above and submits the ways of their improvement.
