Kostiv M. Administrative Legal Personality of Juridical Persons and Peculiarities of its Realization in Administrative-Tort Relations.

In the dissertation the complex research of theoretical principles and peculiarities of administrative legal personality of juridical person's realization is carried out. In the dissertation the concept of administrative legal personality of juridical persons is found out, the elements of legal personality are investigated, their parity are determined and a recognition of administrative tort capacity as an independent element is proved. The author determines the criterias of administrative legal personality of juridical persons classification on special and exclusive, ascertains their contents and value, allocates their separate types and their definition, their contents and value; proves the features of administrative legal personality realization the state bodies, determines subjects of enterprise activity and associations of citizens, investigates peculiarities of the realization of juridical persons' administrative legal personality in administrative-tort relations and analyses tendencies of the modern legislation concerning establishment of administrative responsibility of juridical persons. On the basis of conducted research, the dissertator made conclusions, proved and formulated proposals concerning improvement of legislative settlement of juridical persons' administrative legal personality, and also gave recommendations concerning the effective mechanism of its practical realization.
