Essay

The dissertation represents the complex research of the essences, functions, structure, features of forming, development of a legal system in connection with a solution of problem of the human rights in conditions of democratic, social-lawful state; the research on a problem of integration of Romance-German legal block countries in conditions of globalization; the determination of a place and role of Ukraine in these processes, which promote development of democracy at modern dynamic stage of its history. The performed research has shown that notion of human rights in Romance-German legal system has neatly determined classified structure. It was also determined a connection between notion of legal system as social-state phenomena and notion of human rights. Analysis of legal systems of some countries, namely Germany, Poland and Russia, has confirmed these assertions. The author has drawn attention that constitutional practice of different states lead to decrease of contradiction between natural-legal and positive-legal approaches to human rights. The common human principles and human rights are the conditions to approach of the legal systems in the world. The author has noted that in connection with Ukraine has became a member of the Council of Europe it has to follow to common European laws on human rights.
