Hetman O. Theoretical methodological problems of historical legal science in the works of Ukrainian scientists of XIX – beginning of XX century

The thesis is a research that gives a complex historical analysis of the contribution made by native scientists into working out of theoretical methodological problems of historical legal science. The thesis gives a characteristics of the role of native scientists and place of the theoretical methodological problems in their scientific work. The author found out and analysed the main trends of theoretical methodological searches of pre-revolutionary native scientists. They are: the role and significance of historical legal science; the system of historical legal branch of science; the subject and task of the history of law; correlation and interdependence of the history of law with other branches of science; the structure of the history of law: the division into external and internal parts; the main approaches and methods of research of the history of law; theoretical methodological problems of the history of law and state doctrines. The thesis ascertains the significance of theoretical methodologicalideas of the Ukrainian scientists of XIX – beginning of XX century on the modern stage of development of native historical legal science and gives recommendations as to taking into account the historical experience in the process of modern reconstruction of native historical legal science.
