Prylutskyi P. The problem of the truth in the criminal procedure of Ukraine.

The dissertation is dedicated to the problem establishment of truth in the criminal procedure of Ukraine. In this work is analyzing beginnings and development it issue in historical context. The etymology of the term "truth" is investigated in the dissertation and it's correlation with terms "entirety", "comprehensive" and "unbiased" in the criminal procedure. The differentiation members of criminal justice are coming to life for their functional role towards ascertainment truth in criminal case. In this work is analyzing theoretical aspects evidence as modus establishment truth in criminal procedure and are effected it separation from judicial knowledge. It is considering problems of sources of evidence in criminal procedure of Ukraine. In the dissertation is analyzing method formation of the moral certainty of the judge in criminal case. This is examined negative factors that can to influence for formation of the moral certainty of the judge and courses them negotiation. In this work the author arecame to a decision about necessity maintenance the term "truth" in criminal procedure of Ukraine and propound courses perfection method of sources of evidence and method administration of justice for moral certainty.
