Essay

This dissertation is devoted to criminal liability for failure to duly perform or improper performance of professional or official duties with respect to children's life and health. The author looks at historic, social, legal and criminological factors that conditioned establishing criminal liability for the above offence. She analyses the characteristics of the corpus delicti stipulated in art. 137 of the Criminal Code (the object and objective side, subjective side and the subject) and shows the features that allow to distinguish this offence from other related ones. The author suggests new wording for Art. 137 of the Criminal Code.
