Essay

The thesis is devoted to the issue of the law-applying discretion. Special attention is given to the definition of the notion of the law-applying discretion, the sphere of its existence, its margin and classification. The issue of the law-applying discretion realization is thoroughly examined. The author has analyzed law-applying discretion within the national legislation, he also has defined some shortcomings of the national legislation, and compared norms of the national legislation with the provisions of the international law.
