Antonyuk N. Criminal liability for infliction of property damage by way of fraud or abuse of trust

The thesis researches the issues related to criminal liability for the property damage infliction by the way of fraud or abuse of trust (Art. 192 of the Criminal Code of Ukraine) employing consecutive portraying of elements and features of the crime. In particular, the following forms of the crime are being suggested to be included into the disposition of the article: unlawful temporary borrowing of the property and avoidance from payment for non–material property (energy, services, works). Some problem questions related to the consequences of this crime are also being analyzed in the thesis. In particular it is being stated that property damage caused by crimes generally includes direct damages and lost profits.
