Myagkov M. Discouraging Exercising Of The Electoral Right: Problems Of The Criminal Responsibility

The thesis is a complex scientific research of problems of the criminal responsibility for discouraging exercising of the electoral right. In this work specific and direct objects of the mentioned crime, signs of the objective side (act of discouraging exercising of the electoral right, ways of its committing) were defined, the subject and the subjective side were investigated, the problems of criminal – legal qualification were covered. On the basis of the analysis of system of legislative acts, the scientific literature and materials of law practice was made the general conclusion about imperfection of a disposition of the 157 item of Criminal Code of Ukraine and was offered the new edition of the mentioned criminal-legal norm.
