Sakharuk T. Sentencing Guidelines in Criminal Law of Ukraine and Foreign Countries: Comparative Analysis.

The dissertation is devoted to the problems of assigning sentencing in accordance with criminal law of Ukraine and foreign countries. The author provided the definition of general principles, determined number of approaches in the criminal law of different countries to criteria the court shall take into account in sentencing. In the dissertation the system of general principles of sentencing is specified. The author discovers the essence of a gravity of an offence, offender's characteristics and mitigating and aggravating factors. The influence of these criteria on individualization of punishment is determined. Result of the research lies in forming of recommendations and propositions directed to perfection of the criminal legislation of Ukraine concerning determination of general principles of assigning of a punishment.
