Samojlova O. Criminal-Law Characteristic of Transfer or Collecting Data Containing Confidential Information that is in Property of the State.

The dissertation is devoted to the problem of protection of the data containing confidential information that is in property of the state by criminal-law means. The author has researched the history of development of legislation concerning information with limited access, international law norms, acts of foreign countries, which regulate human right to information. Requirements to restriction of this right have been researched. Besides, a comparative analysis of foreign countries legislation on protection of information with limited access has been conducted by criminal-law means. Objective and subjective characteristics of transfer or collecting data containing confidential information that is in property of the state have been originally defined. A special attention in the research is paid to the analysis of law regime of information with limited access and its variety - confidential information that is in property of the state.
