Belova O. The criminal and legal characteristics of the system of criminal actions against family and minors

The thesis presents a complex scientific research of the system of criminal actions against family and minors, analyses the historical roots and social causes of the legal defense of family and minors, the principles of criminalization of these actions. The author determines the object of criminal actions against family and minors that is family relations as well as the relations that ensure the normal (harmonious) development of minors. The analysis of the object proved the necessity, purposefulness and possibility to single out a separate section in the Special part of the Criminal law „Criminal actions against family and minors”. The place for this section in the Special part of the Criminal law is found. Criminal actions against family and minors have been ranged according to direct object. On the basis of this principle criminal actions are placed into three groups: 1) encroachment upon property family relations; 2) encroachment upon non- property family relations; 3) encroachment upon relations that ensure normal (harmonious) development of teenagers. Objective and subjective features of facts of crimes against family and minors were analyzed; on the basis of the scientific research suggestions to improve criminal and legal norms that provide criminal responsibility are submitted.
