Oksana Y. System of Labour Law Principles in Ukraine

The thesis deals with the complex investigation of theoretical and practical problems of the system of Labour Law principles in Ukraine. Basic general theoretical approaches to understanding of law principles were analysed on the ground of which basic signs of law principles were singled out and notions of Labour Law principles were defined. The tenets that principles of law and norms of law shall be considered as fundamental, basic, structure-forming and independent elements in the system of law were grounded. Peculiarities of revealing general lawful interbranch principles in the system of Labour Law principles in Ukraine are discussed. Core of basic branch principles of Labour Law were analysed. Necessity of legislative consolidation of basic Labour Law principles in the new Labour Code in Ukraine were grounded. Basic types of Labour Law institutional principles in Ukraine were defined. Peculiarities of the core of principles such as fixation of the labour function of a worker, provision of the decent remuneration, guarantee of the right to rest were analysed.
