Kholod R. Legal status of juvenile in the pre-tial investigation

Об'єкт дослідження - the public relations arising on pre-trial investigation on businesses about crimes of the minors. Мета дисертації - engineering of questions of a regulation and ensuring of the legal status of the minor charged on pre-trial investigation, ways of the decision of theoretical and practical criminal procedure problems connected to ensuring of its rights by observance to them of the duties. Методи дослідження - system-structural analysis, historical-legal, rather-legal, logic-normative, sociological, statistical. Наукова новизна - system the offers on supplement of the criminal procedure legislation of Ukraine by other rights of the minor charged are brought in; it is offered to establish circumstances, when participation of the teacher, psychologist at interrogation of the minor charged necessarily; it is offered to extend the rights and duties of the legal representative of the minor charged on pre-trial investigation. Практичне значення - in research sphere: for engineering the theoretical provisions of the legal status of the minor charged; in law of activity: for improvement of the legislation of Ukraine and draft CPC of Ukraine; in practical activity: for improvement of investigation of crimes of the minors; in educational process: at recital of a rate "Criminal procedure" and other. Предмет і ступінь впровадження - the basic provisions of the dissertation are directed to Committee of the Supreme Body of Ukraine on legislative ensuring of law-enforcement activity (act from 29.09.2005), Main investigatory management MIA of Ukraine (act from 18.01.2006) and Investigatory management MIA of Ukraine in the Zaporozhye area (act from 08.06.2005). Ефективність впровадження - conclusions and the recommendations have received a positive rating of the experts.
