The dissertation deals with the theoretical and practical problems connected with application of a preventive punishment in the form of custody. This work discovers the essence and the grounds of application of a preventive punishment indicated above. The procedural status specificity of trial participants during the examination if issue of application of a preventive punishment in the form of custody is explored. The subject of proof is disclosed. The measures towards the improvement of the legislation about the order of appeal of the application of a preventive punishment in the form of custody are proposed.
