Essay

The dissertation contains a comprehensive research of the genesis and the socio-criminological preconditions for the legal regulation and implementation of amnesty in Ukraine and abroad. Following the new trend of criminological research, i.e. “the Criminology of Law”, the author substantiates and implements the idea of studying amnesty within the frame of the Criminal Justice system of Ukraine. The dissertation defines the concepts of legal regulation, the grounds, place and role as well as the main functions of amnesty, determining the interrelation between amnesty and crime rate. The author identifies the ways in which these two phenomena affect each other. The dissertation contains elaborate criminology-based propositions aimed at making amnesty a more perfect and effective institution, since it is one of the means for exercising legal influence upon offenders.
