Polyansky E. Sentencing under U.S. law

The dissertation is the first complex research of sentencing under U.S. law in Ukraine. Due to methodology of criminal law theory the system of sentencing is being researched, there are proofs given to justify separation of sentencing theory from general theory of punishment. Genesis of U.S. federal sentencing doctrine is being studied; federal sentencing system based on formal sanctions is analyzed; the definition of Sentencing guidelines is given. The comparative analysis of characteristics of separate jurisdictions sentencing systems is performed. There are propositions given due to rationalization of criminal sentencing law of Ukraine. New versions of articles 51, 52, 56, 63, 65, 69 of Criminal Code of Ukraine are given.
