Shehovzova L. Emotional condition of the person who have committed a crime, under the criminal legislation of Ukraine.

The dissertation is integrated scientific on the level of a monograph about emotional condition of the person who have committed a crime, under the criminal legislation of Ukraine. In work the urgency and importance of consideration of questions of an emotional condition of the person for a criminal - legal science and his(its) value for the right as applied activity is proved. The condition of scientific development of problems of an emotional condition of the person who has committed a crime, in the criminal - legal doctrine is determined. The place of an emotional condition of the person in system of attributes of the subjective party(side) of structure of a crime, and also features of an establishment of an emotional condition of the person is found out during qualification of crimes, the concept and essence of each kind of an emotional condition of the person is determined. Influence of an emotional condition of the person on norms and institutes of the General(Common) part of criminal law of Ukraine is investigated and influence of an emotional condition of the person on the criminal liability for separate kinds of crimes which are stipulated in the Especial part of the Criminal code of Ukraine is analysed. Оn the basis of the received results scientifically proved offers directed on improvement of the criminal legislation of Ukraine concerning an emotional condition of the person, committed a crime are brought.
