Kovalenko E. The application of operative information as the ground for using the measures of process compulsion in criminal jurisprudence

Об'єкт дослідження - set of the public relations of criminal-legal character arising during use of the operative-search information as of the basis for application of the remedies of processual coercion. Мета дисертації - engineerings of problems of use of the remedies of processual coercion, and also entering scientifically - are proved of provisions and recommendations concerning use of the operative - search information as the bases for conducting investigatory actions, use of other remedies of processual coercion. Методи дослідження - historical-legal; functional; system-structurally; logic-legal; rather-legal; statistical; sociological. Наукова новизна - for the first time it is offered to fix in CPC of Ukraine standard giving the right to the inspector to get acquainted with operative - search materials, concerning criminal case; is proved, that the Law of Ukraine " About operative - search activity " should be added by standards solving to use materials OIW for detainment of the searched personsand the suspects in committing a crime; it is offered to exclude as investigatory action "removal of the information from channels of communication". Практичне значення - results of research can be used: in research job - as a basis for the further scientific engineerings of legislative regulation of use of the operative - search information; in legislative job - at modification in CPC of Ukraine; in methodical job - by preparation of separate sections of the educational and education-methodical grants at the rate "the criminal Procedure of Ukraine". Суб'єкт і ступінь впровадження - basic provisions and conclusions of the dissertation were formulated in the offers directed to Committee of the Supreme Body of Ukraine on legislative ensuring to law-enforcement activity, in the Main investigatory management MIA of Ukraine, in investigatory management Department MIA of Ukraine in Donetsk area. Ефективність впровадження - conclusions and the offers have received a positive rating of the experts. Сфера використання- law and practical activity of the law-enforcement agencies of Ukraine and educational process.
