Simutina Y. The methods of the regulation of the salary at the present stage (legal problems).

The thesis is devoted to the complex investigation of the theoretical and practical problems of the methods of the legal regulation of salary in the market conditions and also the creation of the proposals to providing its efficiency in the new Labour Code of Ukraine. The concept of the salary as category of labour law is defined; its main features that allow to differ salary from other types of payment to the worker and also rewards in the civil and legal contracts is examined. The proposals on the delimitation the concepts of methods, ways and levels of the legal regulation of salary are grounded. The main state guaranties in the labour payment such as minimum salary, minimum norms and rate of labour payment in the deflections from the normal conditions of labour, the restriction of the allocations from the salary under authority of the employer etc. are researched. The main role of contract ways of regulation of the labour payment in the present conditions is proved, the problems of collective-contract and individual-contact regulation of labour payment are researched and also models of legal norms dedicated to contact regulation of labour payment in the new Labour Code of Ukraine are formulated.
