Illina O. Criminal law description of aggravations of profit crimes against property.

Thesis is dedicated to comprehensive analysis of aggravations (qualificatory characteristics) of profit crimes against property. A legal nature of aggravations is investigated. Is asserted that aggravations appears as legal facts by their legal nature. Aggravations of General and Special parts are defined by identity of most general characteristics, and these characteristics allow using generic concept of "aggravations" regarding to them. It is ascertained that aggravations of General and Special parts are play different parts in criminal law regulatory mechanism. Aggravations of General part act as actual basis "fragment" for taking of individual law-applying act (court prosecution verdict), which act is bounded to cessation of criminal law general protection relations. Aggravations of Special part serve as a part of actual staff, which is bounded to appearing of criminal law relations. An impact of aggravations on criminal responsibility is investigated. Classification of aggravations of profit crimes against property is conducted. Individual aggravations of profit crimes against property have been examined.
