Serykh O. Tort Science of Customs Rules Violations

The dissertation is the first complex research dedicated to the scope of customs rules violations, their causes and conditions and preventive measures of the violation. The necessity of the customs rules violation studying as a part of administrative tort as well as the existence of new scientific approach – Tort Science of Customs Rules Violations – is grounded. The delictual characteristics of customs violations such as the conditions, structure, dynamics, and geography are thoroughly considered. The methodology of delictual research of customs rules violations is developed. The research defines a new notion such as «customs tort», «Tort Science of Customs Rules Violations», and «causes of customs rules violations», «conditions caused customs rules violations», «prevention of customs rules violations». Practical recommendations on the improvement of Customs bodies’ activities concerning the struggle against customs violations are suggested. The thesis contains the complex analysis of the current legislation on customs issues and the practice of its implementation as well as the statistics materials.
