Kutsevych M. . Criminal responsibility for ecocide: international and national aspects.

The dissertation is the complex research on criminal responsibility for ecocide. On the ground of made analysis of features of ecocide as an international crime author considers it as a crime against security of mankind, formulates it's specific normative features and gives a scientific notion of it under the international criminal law. As the result of analysis of the body of crime of ecocide under the Criminal code of Ukraine it's made the conclusion that it is purely intentional crime, the objective side of this crime includes action, primary consequences (damaged environment) and derived consequences in the form of the threat of ecological catastrophe (extraordinary ecological situation). The recommendations concerning delimitation of ecocide and adjoining crimes, and qualification of cumulative crimes have been given. On the ground of made comparative research there have been given propositions concerning improving of some regulations in Criminal code of Ukraine especially the new wording of 441 article of Criminal code of Ukraine.
