Ternavskay V. The institute of jury in Ukraine (historical-juridical aspect).

The complex research in a historical-legal aspect of becoming process of the jury as the judicial institute and its further development is carried out in dissertation. Author makes conclusion about the assistance in the institution of the institute of jury on Ukrainian lands during the judicial reform of 1864 of existence of the judicial institute in the system of Ukrainian judicature of the Middle Ages, having peculiarities of the jury, where a kopniy court is the prototype of the given institute. In order to study foreign experience and to determine all positive and negative factors in the activity of the given institute, the modern position of the jury in the judicial systems of England, the USA, France and RF is analyzed. On the basis of the conducted research the suggestions about creation of terms of assistance of becoming and effective activity of the institute of jury in the judicial system of Ukraine are formulated. The author's definition of notion of the jury is given in dissertation.
