Malyj V. Legal regulation of the land hypothecation (mortgage) in Ukraine

The dissertation research is dedicated to the actual problems of application of the law institute of the land hypothecation (mortgage) in Ukraine. Chapter I of the research contains the data on the development of the land hypothecation institute in historical retrospective. The concepts and legal forms of the land hypothecation in acting legislation are examined in this work. The dissertation also reviews foreign experience in application of the land mortgage institution (in such countries as Germany and Russia). Chapter II examines the main methods of legal regulation of the law institute of the hypothecation in Ukraine: pure law, civil law, private law, legislation. The author of the dissertation studies the problems of organizational provision of the mortgage and hypothecation-credit relations. Special attention is paid to the issues of the amenability for law violation in the field of the land hypothecation. The work is of special interest for the practical implementation by legislators, theoreticians, jurists.
