Essay

The work deals with systemic study of views on the problem of the private and public law of scientists working at Universities on the territory of Ukraine in XIX-beginning XX centuries. The process of study of the private and public law can be divided into three large periods. The first period, the period of the study origin, includes the first half of XIX century. The second period (second half of XIX century - up to 1917) was characterized with the original views of the Ukrainian scientists on differentiation of the private and public law. The third period embraced 20-th years of XX century during which the leading was the idea of the unity of the system of socialist law, though there were individual views on the necessity of such differentiation preservation. The result of the scientific search was bringing out the criteria of the private and public law differentiation that will have significance for the modern law creative and law applicable practice in Ukraine.
