The fhesis is dedicated to the problems of the Criminal low of the change the punishment more soft one during it's serving of a sentence. The legal nature and the signs of the change the punishment, the problems of it's delimiting of the adjacent legal institutes and rates, concrete types of the change the punishment are researched in it. The premiseses, basis, order and criminal-legal consequences of the using the change the rest part of the serving of a sentence more soft one were analysed theoreticaly (item 82 of the Criminal Code of Ukraine).
