The thesis is devoted to the study of corpus delicti attributes of article 364 of the Criminal Code of Ukraine (abusing authority or service position) for its correct qualification, and also to the formulation of offers to improve this norm in the long term. The attention is given to questions of delimitation of the action stipulated by article 364 of the Criminal Code of Ukraine from other crimes in sphere of service activity, and also from other adjacent crimes.
