Essay

The dissertation is devoted to the problems of the criminal responsibility for abuse of military service power or a position of a person in office. It is analyzed objective and subjective indications of body of the crime that the article 423 of the Criminal Code provides. It is studied different points of criminological characteristic of a criminal's personality as a subject of a crime whose case is tried. The proposals are made for to improve the corresponding provisions of the Criminal Code of Ukraine in force and its implementation.
