Kelman L. Social-political Factors of Influence on Law Enforcement Activity

The thesis deals with the problem of researching the peculiarities of the influence of the social-political factors on the law enforcement activity. The concepts of the law enforcement activity which exist in the scientific literature and are a specific variety of the social activity are analyzed and specified. The nature of the law enforcement activity is characterized. The definition of the social-political factors is formulated and the peculiarities of their influence at every stage of law enforcement are investigated. The criteria of the distribution are grounded and the classification is proposed, according to which the social-political factors are of external and internal influence. It is proved that the influence can be objective and subjective and according to this it can be positive and negative. The conclusion is that the effectiveness of the law enforcement activity depends on the level of revealing and taking into account the social-political factors. Particularly it will make it possible to foresee and prevent the appearance of the legal collisions and deficiencies. A proposition is made as to the improvement of the Ukrainian legislation.
