Essay

The Dissertation is the first research work in Ukraine on responsibility for the crimes against person’s freedom. The author defines the notions „a crime against person’s freedom”, „the right to freedom”, „the right to immunity”, „illegal disfranchisement of freedom”, „kidnapping”, „the sailing of people”, „slavery”, „slave-trade”. The author investigates the plot of the main object of the crimes against person’s freedom, defines features of the objective characteristics of illegal crimes against person’s freedom or kidnapping, the sailing of people or other illegal removing of people, illegal placing to the mental hospital, slavery, the substitution of a child, as well as the subjects of illegal placing to the mental hospital. The matters of qualification of the encroachments to person’s freedom are defined in the work as well as the separation of the related kinds of crimes. The recommendation on improving criminal legislation of Ukraine are grounded with the aim to put the responsibility for the crimes against person’s freedom; the reduction of the norms of 1-2 articles on the responsibility of illegal deprivation of freedom, person’s kidnapping, trafficking in people or other illegal agreement of person’s moving, the reduction of the article “Slavery or slave’s trading” has been proposed.
