Lysko T. Criminal responsibility for the rape (comparative legal analysis)

The dissertation represents the first complex comparative legal research regarding the problems of the criminal responsibility for the forceful rape. The presentational dissertation envisages certain conceptual approaches to the comparative research method in criminal law, entails classification of the basic legal systems and their general characteristics. The comparative legal research of the responsibility features for the forceful rape under Ukrainian criminal legislation as well as under the legislations of certain foreign countries is fully developed in the present dissertation. The basic terms and concepts, objective and subjective attributes of the forceful rape are comprehensively investigated in the PhD research. The dissertation also performs the comparative legal analysis of the aggravating circumstances of the forceful rape and its punishment features under the criminal legislation of Ukraine and certain foreign states. Based on the research results the dissertation tenders the offers on the improvement of the current legislation and practice of its enforcement.
