Galina A. Legislative Regulation of Social Partnership in Ukraine

The thesis deals with the complex investigation of theoretical and practical problems concerning legislative regulation of social partnership in Ukraine. Analysis of the development of the Ukrainian legislation on social partnership allowed to determine seven stages of its formation and development. The notions of social partnership and the form of social partnership were defined. The basic forms of social partnership were examined. It was postulated that the basic forms of social partnership are: the process of collective negotiations on concluding collective contracts and agreements; employee participation in the enterprise management; reciprocal consultations of the parties on labour relation regulation; mediatory reconciliation of collective labour disputes; monitoring the implementation of reciprocal commitments made by the parties of social partnership. Peculiarities of the legal standing of the state, municipal authorities, employers, labour unions and other employee organizations as the subjects of social partnership were analysed. The conducted analysis of the practice of concluding collective contracts and agreements enabled to suggest the necessity of introducing relevant amendments and supplements to the valid Law on collective contracts and agreements.
